Welcome to United Blacktop Inc.! These terms and conditions ("Terms") govern your use of our services, including but not limited to asphalt paving and sealcoating services ("Services"), provided by United Blacktop Inc., located in Suffolk County, New York. By accessing or using our Services, you agree to abide by these Terms. If you do not agree with any part of these Terms, please do not use our Services.

Driveway Sealcoating:

Arrival Time:

*** WE DO NOT PROVIDE ARRIVAL TIMES. *** Our technicians prioritize efficiency by organizing their list of jobs in the most convenient order. This means we are unable to provide specific arrival windows. However, you will receive an "On My Way" text notification from the technician when they are en route to your location.

Weather Permitting:

*** ALL WORK IS CONTINGENT UPON FAVORABLE WEATHER CONDITIONS. *** If rain is forecasted or conditions are not suitable, we will contact you the morning of your appointment to reschedule. We appreciate your flexibility and understanding in maintaining the quality of your job.

Access & Preparation:

Please ensure the driveway is clear of vehicles, personal items, and debris before our arrival. Please leave room in front of the driveway for our truck and tar tank trailer. If your asphalt goes under the garage door you can leave it cracked open about 2 feet for the guys to seal underneath.

Post Job Completion:

Upon completion of the job, the driveway will be ready for foot traffic in 6 hours, and vehicles can return to the driveway in 48 hours. Upon completion, the driveway will be roped off with fluorescent ribbon to prevent foot traffic or vehicles from entering until the surface is fully cured.

Payment Terms:

  1. Payment Due Upon Completion: Payment for our Services is due upon completion of the work, unless otherwise agreed upon in writing by United Blacktop Inc. Failure to make payment upon completion may result in additional charges as outlined below.

  2. At United Blacktop we take great pride in delivering high-quality service and ensuring our customers are happy with the results. Your feedback is very important to us, as it helps us maintain and improve our standards.

    Payment Terms for Jobs Over $2,500:
    For projects exceeding $2,500, our payment structure is as follows:

    • First Payment: 1/3 of the total amount is due upfront before the commencement of work.

    • Second Payment: 1/3 of the total amount is due midway through the project.

    • Final Payment: The remaining 1/3 is due upon completion of the work and your approval.

  3. Late Payment Fee: Clients are responsible for ensuring timely payment. A late fee of $50 will be charged per week for payments not received within 30 days of the invoice date. This late fee will continue to accrue on a weekly basis until payment is made in full.

    Late Payment & Collections Policy

    Payment Terms: Payment for all invoices is due in full upon completion of services unless otherwise specified in writing. Any unpaid balances are subject to the following terms:

    Late Fees: Invoices not paid by the stated due date will incur a late fee of [insert % or $ amount, e.g. 2% of the outstanding balance per month or a $25 flat fee per late notice], beginning the day after the due date. Continued failure to pay may result in additional late fees and accrued interest as permitted by law.

    Escalation & Collections: If an invoice remains unpaid 14 days past the due date, {{COMPANY_NAME}} reserves the right to escalate the matter to collections, which may include referral to a third-party collections agency or pursuit of legal action to recover the debt. Any collection costs or legal fees incurred will be added to the outstanding balance and become the responsibility of the client.

General Terms:

  1. Scope of Services: United Blacktop Inc. provides asphalt paving and sealcoating services as described on our website and as agreed upon in writing with the client. Any additional services requested by the client may incur additional charges.

  2. Client Responsibilities: Clients are responsible for providing accurate and accessible information regarding the location and condition of the project site. Any delays or complications arising from inaccurate or incomplete information provided by the client may affect the completion timeline and incur additional charges.

  3. Warranty and Liability: United Blacktop Inc. warrants that our Services will be performed in a professional and workmanlike manner. However, we do not warrant against normal wear and tear or damage resulting from misuse or neglect. Our liability is limited to the cost of the Services provided.

  4. Intellectual Property: All content, including but not limited to logos, designs, and text, on the United Blacktop Inc. website and related materials are the intellectual property of United Blacktop Inc. and may not be used or reproduced without permission.

Governing Law:

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or our Services shall be resolved exclusively in the state or federal courts located in Suffolk County, New York.

Changes to Terms:

United Blacktop Inc. reserves the right to update or modify these Terms at any time without prior notice. Any changes will be effective immediately upon posting on our website. Your continued use of our Services after the posting of revised Terms constitutes your acceptance of such changes.
